EGH Attorney Jason Tuttle obtained a recovery of $279,000 for a 26 year old struck head on by a drunk driver. The young man suffered a skull fracture with intracranial hemorrhage, right femur fracture, spleen laceration, multiple facial fractures including an orbital fracture, pneumothorax, and multiple thoracic fractures. His injuries were substantial, but he was able to make a miraculous recovery finishing treatment in less than six months. Although delayed, he embarked on a new career path upon completion of treatment.
The drunk driver was cited by police for DWI and failing to maintain lane control. Unfortunately he only had minimum policy limits of $30,000 and no other assets of note. The insurance company for the drunk driver tendered its policy limits.
However, this came nowhere close to full and fair compensation for our client’s injuries. Our 26 year old was without health insurance, and medical providers alone asserted initial liens of approximately $149,000.
Three additional insurance policies were identified by EGH attorneys. Our client lived with his parents and sisters, who each had auto insurance policies with Underinsured Motorist (“UIM”) coverage. UIM coverage comes into play when the at-fault driver’s insurance coverage falls short of the full value of damages in the case.
An additional $249,000 was paid by the UIM carriers, and EGH attorneys negotiated a lien reduction of almost 40% with medical providers. This allowed our client to not only pay his medical bills but to also receive significant settlement funds for pain and suffering and future medical treatment.
