$1.6 Million Settlement for Motorcyclist Injured in Crash

Everett Gaskins Hancock attorney Jason Tuttle and co-counsel Hill Allen of Tharington Smith helped a 35 year old motorcyclist recover a total of $1.6 million in compensation for injuries from a July 2021 accident.  Their client was operating a Harley Davidson motorcycle when a driver in a 2018 Subaru sedan failed to yield the right of way while making a left turn.  Her vehicle struck their client and pinned him beneath his motorcycle.  A bystander was able to pull their client away from the wreckage and provide help until EMS arrived.

Their client had numerous injuries requiring multiple surgeries.  The most significant injury being the left leg fractures resulting in amputation above the knee.  In addition, their client also suffered a right knee fracture, T-12 fracture, left humerus fracture, right hand fracture, nasal bone fracture, and left shoulder rotator cuff injury resulting in surgery.

Special damages, including paid and future medical bills, totaled $570,000.  Included in this amount was the cost for a state-of-the-art prosthetic leg.

Jason and Hill were able to recover $1.25 million in insurance proceeds and $350,000 from the at-fault driver personally.  They further aided their client by negotiating an approximately $320,000 reduction in medical liens.  This matter was resolved pre-suit.
